Flashend.com provides cloud-based services including but not limited to web hosting, cloud storage, and content delivery networks.
Service Availability
We strive to maintain the Service availability but do not guarantee uninterrupted access. We may perform maintenance that could result in service interruptions.
Service Modifications
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
Note: We aim for 99.9% uptime for our services, but this is not a guaranteed service level. For guaranteed uptime, please refer to our Service Level Agreement.
Payments and Billing
Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to our pricing and payment terms.
Billing Cycle
Subscription fees are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds for partial months of service.
Price Changes
We may change our prices at any time. When we do, we will provide notice of the change on the Service or by email, at our discretion, at least 30 days before the change takes effect.
Taxes
You are responsible for paying all taxes associated with your purchases. Where required, we will collect and remit taxes to the appropriate authorities.
Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material.
Content Responsibility
You are responsible for the content that you post on or through the Service, including its legality, reliability, and appropriateness.
Content Rights
By posting content on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Service.
Prohibited Content
You agree not to post content that:
Is illegal or promotes illegal activities
Infringes on any third party's intellectual property rights
Contains malware or malicious code
Is pornographic, obscene, or sexually explicit
Harasses, intimidates, or bullies any individual

In no event shall Flashend.com, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.
No Warranty
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind.
Indemnification
You agree to defend, indemnify and hold harmless Flashend.com and its licensees and licensors from and against any claims, damages, obligations, losses, liabilities, costs or debt.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Dispute Resolution
Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in Delaware, rather than in court.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect.
Continued Use
