Introduction

In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), Flashend.com has adopted the following policy toward copyright infringement on its services.

Our Commitment

Flashend.com ("we", "our", or "us") respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA.

Important Notice: This policy is designed to make submitting notifications of alleged infringement to us as straightforward as possible while reducing the number of notices that we receive that are fraudulent or difficult to understand.

Copyright Infringement Notification

If you are a copyright owner or an agent thereof and believe that any content on Flashend.com infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing:

Required Information

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

Counter Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter notification with us by providing our Designated Agent with the following information in writing:

Required Information

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Flashend.com may be found, and that you will accept service of process from the person who provided notification under DMCA 512 subsection (c)(1)(c) or an agent of such person.

Process After Counter Notification

Upon receipt of a valid counter notification, we will forward it to the original complaining party. The original complaining party will then have 10 business days to notify us that they have filed a court action relating to the material. If we do not receive such notification, we may restore the material.

Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to terminate user accounts for a single infringement in appropriate circumstances.

Our Enforcement Policy

We maintain a record of DMCA takedown notices and make reasonable efforts to identify repeat infringers. When we have a reasonable belief that a user is a repeat infringer based on multiple DMCA notifications, we will take appropriate action, which may include termination of the user's account.

Processing Time

We will respond to all valid DMCA notifications within a reasonable time frame, typically within 1-3 business days. Please note that we may need to contact you for additional information to process your request.

Changes to This Policy

We may update this DMCA Policy from time to time. We will notify you of any changes by posting the new DMCA Policy on this page and updating the "Last updated" date.

Notification of Changes

If we make material changes to this policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this DMCA Policy periodically for any changes.
